01When should I contact a lawyer when buying a home?

As soon as possible. Once a lawyer is involved they can start working to protect your interests. Buyer beware is still the law in Ontario, so check the home carefully and insist on the vendor delivering a completed and signed Vendor Disclosure Statement before your offer.

02What will you need from me once I retain you?

A copy of the Agreement of Purchase and Sale including all waivers and schedules, the full legal names, dates of birth and current contact information of everyone going on title, and photo identification for each of them.

03How long does a review of my agreement or status certificate take?

Documents are reviewed within 36 hours of receipt, and Travers Law offers this legal review free of charge.

04Should I get title insurance?

Yes. Title insurance is a form of indemnity insurance covering financial loss from undetected or unknown title defects for as long as you own your home. Even a rightful owner's title can come into question, for example through real estate fraud.

05How should we take title to the property?

There are several ways to own real estate in Ontario, each with its own benefits and liabilities: sole ownership, where one person holds title; joint tenancy, where two or more owners hold title equally; and tenancy in common. Speak with your lawyer about which is right for you.

06Do I need to arrange home insurance?

For a property that is not a condominium, home insurance is required and you must provide your lawyer with a copy of your fire insurance binder. An institutional mortgage lender will not advance funds without proof of fire insurance.

07What will I have to pay on closing?

Closing costs often include title insurance, land transfer tax, legal fees, disbursements and HST where applicable. The final balance owing is also usually adjusted for realty taxes, utilities or fuel.

08I am a non-resident. What do I need to do?

Contact the office as soon as possible. You will need to apply for a non-residency clearance certificate through an accountant, and usually 25% of the gross sale price is held, normally by the seller's lawyer in trust, until the clearance is issued.

09Who has to sign the closing documents?

Everyone who holds title must attend to sign. If you are married and title is in one spouse's name only but the property is a matrimonial home, both spouses must attend to sign the transfer, with the other as a consenting spouse.
